13. Arbitration Agreement; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS. (a) Agreement to arbitrate. Except as provided in subsection (d), any dispute, claim, or controversy arising out of or relating to the Site, the Services, or these Terms, including the formation, interpretation, breach, or termination hereof and the arbitrability of any dispute, shall be resolved exclusively by binding individual arbitration administered in Travis County, Texas, by a single arbitrator under the rules of the American Arbitration Association then in effect, and judgment on the award may be entered in any court of competent jurisdiction. (c) Fees. Each party shall bear its own attorneys' fees and costs, and the arbitrator's fees shall be allocated as the arbitrator directs, in each case except as otherwise required by applicable law. (d) Exceptions. Nothing in this Section shall prevent either party from (i) pursuing an individual claim in a small claims court of competent jurisdiction, or (ii) seeking provisional or injunctive relief from a court of competent jurisdiction in aid of arbitration or to prevent infringement of intellectual property rights. (e) Opt out. You may opt out of this arbitration agreement by delivering written notice to Texas Political Jobs, Post Office Box 4378, Austin, TX 73301, US, postmarked within thirty (30) days after you first accept these Terms, in which event this Section shall be of no force or effect as to you. (c) Waiver. No waiver of any provision of these Terms shall be effective unless in writing, and no waiver shall constitute a waiver of any other or subsequent breach or provision. (d) Assignment. You may not assign, delegate, or transfer these Terms or any rights or obligations hereunder, by operation of law or otherwise, without our prior written consent; any purported assignment in violation hereof is void.
